Terms of Use for BigSight

Please read these Terms of Use (“Terms”) carefully before using the BigSight app (“App,” “we,” “our,” or “us”). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using BigSight, you agree to these Terms. If you do not agree, do not use the App. We may update these Terms from time to time, and continued use of the App after changes constitutes acceptance.

2. Description of Service

BigSight is a vision accessibility app that provides tools to help users read text, scan documents, identify objects, and access safety features. The App includes both free and premium subscription features.

Key Features Include:

• Text magnification and reading assistance
• Live text recognition (Reading Lens)
• Document, medication, handwriting, barcode, bill, currency, and expiry date scanning
• Color identification
• Text-to-speech reading
• Fall detection and daily check-in
• Emergency contact management
• Medical ID storage
• Voice commands

3. Not a Medical Device

IMPORTANT: BigSight is not a medical device, and is not intended to diagnose, treat, cure, or prevent any medical condition.

• Medication Scanner: The medication scanning feature uses optical character recognition (OCR) to read text on labels. It may produce inaccurate results. Always verify medication information with your pharmacist or healthcare provider. Never rely solely on the App for medication decisions.
• Expiry Date Scanner: Expiry date detection is based on text recognition and may be inaccurate. Always visually confirm expiry dates when possible.
• Fall Detection: The fall detection feature uses device motion sensors and may not detect all falls, or may produce false alerts. It is not a substitute for professional medical alert systems.
• Medical ID: The Medical ID feature stores information you enter. We do not verify the accuracy of this information. Ensure your medical data is accurate and up to date.
• Daily Check-in: The daily check-in feature relies on local device notifications and SMS messaging. It is not a monitored safety system and should not be relied upon as the sole means of safety monitoring.

4. Eligibility

You must be at least 13 years old to use this App. If you are under 18, you must have the consent of a parent or legal guardian.

5. Subscriptions and Payments

5.1 Free Features

Certain features of the App are available at no charge, including text magnification, read aloud, brightness boost, color identification, reading lens, and emergency contacts.

5.2 Premium Subscription

Access to premium features requires an active subscription, managed entirely through Apple’s App Store.

• Monthly and yearly subscription plans are available.
• Payment is charged to your Apple ID account at confirmation of purchase.
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period.
• You can manage and cancel subscriptions in your Apple ID account settings.
• Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.

5.3 Refunds

All purchases are processed by Apple. Refund requests must be directed to Apple in accordance with their refund policies.

5.4 Price Changes

Subscription prices may change. If the price increases, you will be notified in advance and given the option to cancel before the new price takes effect.

6. User Responsibilities

You agree to:

• Use the App only for its intended purpose as a vision accessibility tool.
• Ensure the accuracy of any personal information you enter (emergency contacts, medical ID).
• Not rely on the App as a sole means of emergency communication or medical safety.
• Keep your device and operating system updated for optimal App performance and security.
• Not attempt to reverse-engineer, decompile, or disassemble the App.
• Not use the App for any unlawful purpose.

7. Intellectual Property

All content, features, design, code, graphics, and trademarks in BigSight are owned by us or our licensors and are protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

You may not:

• Copy, modify, or distribute the App or its content.
• Use the App’s name, logo, or branding without written permission.
• Create derivative works based on the App.

8. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we handle your information. In summary:

• All data is processed and stored locally on your device.
• We do not collect, transmit, or share personal data with third parties.
• No analytics, tracking, or advertising SDKs are used.

9. Disclaimers

9.1 “As Is” Basis

THE APP IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9.2 Accuracy

We do not guarantee the accuracy, completeness, or reliability of:

• Text recognition (OCR) results.
• Medication label scanning and parsing.
• Currency identification.
• Expiry date detection.
• Color identification.
• Fall detection alerts.
• Any other feature output.

9.3 Availability

We do not guarantee that the App will be uninterrupted, error-free, or free from bugs or viruses.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Personal injury or harm resulting from reliance on fall detection or emergency features.
• Incorrect medication information leading to adverse health effects.
• Missed or failed daily check-in notifications.
• Incorrect text recognition or scanning results.
• Loss of data stored on the device.
• Any damages arising from the use or inability to use the App.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP OR SUBSCRIPTION IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including legal fees) arising from your use of the App, violation of these Terms, or infringement of any third-party rights.

12. Emergency Features Disclaimer

The emergency contact, fall detection, daily check-in, and location sharing features are provided as convenience tools only. They are not substitutes for professional emergency services (such as 911 or equivalent).

• Always call emergency services directly in life-threatening situations.
• The App requires an active internet connection and cellular service for SMS features to work.
• Fall detection may not detect all types of falls and may produce false positives.
• Daily check-in notifications depend on device notification settings and may not be delivered in all circumstances.

13. Third-Party Services

The App integrates with Apple’s frameworks and services (App Store, StoreKit, Vision, AVFoundation, etc.). Your use of these services is subject to Apple’s own terms and conditions. We are not responsible for the performance or availability of third-party services.

14. Termination

We reserve the right to terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or us.

You may terminate your use at any time by deleting the App from your device. Active subscriptions must be cancelled through your Apple ID settings.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of India.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the use of the App, superseding any prior agreements.
